Please read our Booking Terms & Conditions below, before you book your retreat:

These Booking Terms and Conditions set out the terms and conditions on which Nourish & Flourish Retreats Ltd will make a retreat available to you.
Please read these terms and conditions carefully before making your booking. By booking a retreat with Nourish & Flourish Retreats Ltd you agree to be bound by the terms and conditions set out below.
1. Making a Booking
1.1 You can make a Booking by sending Us a completed Booking Form.
1.2 When You submit the Booking Form to Us this will be treated as an offer to purchase a place on the specified Retreat. Please make sure that You check that the details on the Booking Form are correct before making Your Booking.
1.3 Upon receipt of Your Booking Form We will check a few things such as availability and suitability of the Retreat and depending on Our findings and Your responses to the Medical Questionnaire (see clause 1.6 below) We will either send You a Confirmation or explain why We cannot accept Your Booking.
1.4 A maximum of 2 people per Booking is permitted.
1.5 We will let You know if there is any change to any of the details (including a change to the Price (if any)) We discussed with You at the time You made Your Booking before We send a Confirmation and You will be free to amend or withdraw Your Booking Form without any liability to Us.
1.6 In addition to Your Booking Form, You must send to us a completed Medical Questionnaire, which will be sent to you upon receipt of your initial enquiry. Confirmation of Your Booking will be dependent upon Us being satisfied with Your responses to the Medical Questionnaire. We may decline Your Booking if You fail to provide a completed Medical Questionnaire or We are unsatisfied with any response given. We reserve the right to request a Certification of health from your General Practitioner at any stage prior to or following Confirmation.
1.7 The contract between You and Us will be completed and become binding on You and Us when We take any payment from You.
1.8 Where more than 1 person is named on the Booking Form You acknowledge and agree that You are making the Booking and receive the Confirmation on behalf of all named persons and confirm that You have full authority to do so. You also confirm that each named person is fully aware of and accept these Terms. We will hold the person who makes the Booking personally liable for any breach by any of their party of these Terms.
2. Changes to Your Booking
2.1 We hope that We will not have to make any changes to Your Booking or the Retreat but, because bookings are planned many months in advance, this is sometimes unavoidable. We reserve the right to make changes to Your Booking or to correct any obvious errors in the details of Your Booking at any time. We will let You know of any changes to Your Booking as soon as We can and try Our best to do so before Your Departure Date if there is time.
2.2 If We make a major change to Your Booking then We will offer You either: (a) a refund of any sums You have already paid to Us; (b) alternative arrangements of a similar standard to those originally booked (if available); or (c) alternative arrangements of a lesser standard to those originally booked in addition to a refund of an amount that we deem to be a monetary representation of the difference between the alternative arrangements and Your original Booking. We do not accept any liability for any further costs You may incur as a result of such changes.
2.3 If You wish to make a change to Your Booking please contact Us and We will do Our best to help. If We are able to accommodate Your request We may increase the Price to account for the cost of any additional member added to Your Party. We will notify You of the total cost of Your proposed amendments in writing. The price of Your new arrangements will be based on the prices that apply on the day You ask for the change. These prices may not be the same as when You first made Your Booking.
3. Price and payment
3.1 Subject to the remainder of this clause 3 the Price of the Retreat will be as set out in the Confirmation or otherwise notified to You in accordance with clause 2.3.
3.2 A 25% deposit must be paid upon receipt of Our Confirmation. The balance of the Price will be payable 42 days before Your Departure Date unless You make Your Booking within 42 days of the Departure Date in which case the full Price will be payable upon receipt of Our Confirmation.
3.3 You must make all payments to Us by credit card or bank transfer and in accordance with the timescales stated on the relevant invoice. If You make payment by debit or credit card over the telephone We may charge a handling fee of 2.0% per transaction. You will be responsible for any bank charges levied where payments are made electronically. We will not impose any charges for payments made using online banking.
3.4 We may increase the Price at any time 30 days prior to Your Departure Date to take account of any changes in Our costs of supplying the Retreat including (but not limited to) those resulting from transportation charges (fuel and other transport charges), currency fluctuations and government action. We will forward an amendment invoice reflecting any such changes (Amendment Invoice). The price quoted on any Amendment Invoice we issue is guaranteed unless You change Your Booking. Where we increase the Price by more than 10% You may cancel Your Booking within 10 days of the Amendment Invoice date and We will refund to You all sums paid to Us.
3.5 All prices We quote to You include VAT. However, if the rate of VAT changes on or before the date a payment is due, We will adjust the rate of VAT that you pay, unless you have already paid for the Retreat in full before the change in the rate of VAT takes effect.
3.6 Your financial security is guaranteed and protected. We have in place a package operator’s trust account in accordance with the European Union Package Travel Regulations 1992. This account is administered by Lloyds TSB, 8 Foregate Street, Chester CH1 1XP into which all Retreat payments are placed and will remain until the Retreat is complete. In the event of financial failure before your departure, all monies paid, excluding insurance premiums, will be refunded to you. If financial failure occurs during the Retreat, all sums will be applied to the completion of the Retreat or, if this is not possible, you will be repatriated to the United Kingdom.
4. Accommodation
4.1 Each double room accommodates a maximum of 2 people. If Your Booking is for more than 1 person and You do not wish to share a double room each person must make a separate booking and the Price will vary accordingly. A single occupancy room supplement will apply.
4.2 Please indicate on Your Booking Form whether You desire single occupancy of a double room. Single occupancy is dependent upon availability and is not guaranteed. Should a preference be indicated and single occupancy requested, an additional supplement/payment will be payable by You.
4.3 We will advise You of the check-in and check-out times and other relevant details of Your accommodation prior to departure.
4.4 You will comply with all policies and procedures that may relate to Your stay at the accommodation (such as, by way of example, any non-smoking policies) and agree to abide by all local laws and regulations. You will be responsible for any damage and/or loss to the accommodation caused by You or any member of Your party and shall, upon Our request, reimburse Us for any liabilities, costs or expenses We incur as a result of any such damage, loss or breach of policy, procedures, local laws or regulations. The person in whose name the Booking is made shall be liable in the first instance for any such claims.
4.5 Your property (including but not limited to baggage) shall at all times remain solely at Your risk.
5. Your Travel Arrangements
5.1 All travel arrangements (including transfers to and from the Retreat) are Your responsibility and at Your own cost. We shall not be held liable for any consequences arising from delays to or cancellations of Your travel arrangements.
5.2 You are responsible for arranging and must be in possession of a valid passport and any visas required to travel to and from the Retreat and to stay and participate in the activities.
5.3 While We try to make sure that any information or advice We may provide You in relation to matters such as permits, visas, vaccinations, climate, clothing, baggage, special equipment, airlines and travel connections etc is accurate, we will not be responsible for any errors or omissions. Such information is not intended to constitute specific legal or other professional advice and You should always make independent enquiries.
5.4 If Your failure to have any necessary travel or other documents results in fines, surcharges or other financial penalty being imposed on Us, You will be responsible for promptly reimbursing Us on demand.
6. Provision of the Retreat
6.1 We will provide the Retreat using reasonable care and skill.
6.2 If You participate in the Retreat Activities or any other ancillary activities We may provide it is necessary that You listen to and comply with the instructions of the leader of that activity who is Our representative. By submitting a Booking Form You agree to do so.
6.3 We reserve the right to remove You from an activity or to cancel Your holiday arrangements with Us without any liability on Our part if You commit any illegal act or, if in Our opinion, Your behaviour is likely to cause danger, distress or annoyance to others. If We ask You to leave the Retreat for any reason, You will become responsible for Your own return home and any other members of Your group who cannot or will not travel without You. No refunds or compensation will be paid to You and We may make a claim against You for any costs and expenses incurred by Us as a result of Your behaviour.
7. Events outside our control
7.1 We will not be responsible for any: (a) failure to provide the whole or any part of the Retreat to You; (b) alteration to the Retreat Activities or any other ancillary activities We may provide; or (c) delay or inability to do anything else which We have promised because of something beyond Our reasonable control such as (but not limited to) actual or potential severe weather conditions, flood, lightning, earthquake, fire, explosion, war, civil commotion, riot, terrorist attack or threat of terrorist attack, epidemics, health risks, technical problems with transport or accommodation beyond our control, changes due to rescheduling or cancellation of flights by an airline, closed or congested airports or ports or failure of public or private utility services.
7.2 We will not be responsible for any costs or losses You incur as a result of any of the circumstances described in clause 7.1 including but not limited to the cost of rearranging any travel or obtaining extra or alternative accommodation for the duration of such events.
8. Your cancellation rights
8.1 You may cancel the whole or any part of Your Booking at any time by writing to Us by email or by letter to the address set out in clause 13.
8.2 We reserve the right to charge You a cancellation fee if You cancel Your Booking as compensation for the cost of processing Your cancellation and the risk that We may not be able to resell Your place(s) on the Retreat.
8.3 The cancellation email/cancellation letter must be in the name of the person who made the Booking and that person will be responsible for paying the cancellation fee.
8.4 The cancellation fee is calculated as a percentage of the total Price and the percentage of the Price payable depends on how many days before the Departure Date We receive Your written notice – the more notice You give, the lower the cancellation fee will be.

9. Our cancellation rights
9.1 We may cancel Your Booking for any reason and at any time up to 6 weeks before Your Departure Date. We may also cancel Your Booking at any time for any of the reasons set out in clause 7.1.
9.2 We will let You know as soon as reasonably possible if We have to cancel Your Booking for any reason.
9.3 If We cancel Your Booking under clause 9.1 or 14.4 then We will offer You either: (a) a refund of any sums You have already paid to Us; (b) alternative arrangements of a similar standard to those originally booked (if available); or (c) alternative arrangements of a lesser standard to those originally booked in addition to a refund of an amount that we deem to be a monetary representative of the difference between the arrangements. We do not accept any liability for any costs or expenses You may incur as a result of Our cancellation in such circumstances including but not limited to travel fares, visas or vaccinations.
9.4 We may cancel Your Booking, or any part of it, at any time without any liability to You with immediate effect by giving You written notice if:
(a) You do not pay Us when you are supposed to as set out in clause 6.2. This does not affect Our right to charge You interest in accordance with Our statutory rights;
(b) You do anything to harm Our reputation or to cause offence to other attendees at the Retreat or to Our Representatives; or
(c) a circumstance beyond Our reasonable control occurs as described in clause 7.
10. Our liability to you
10.1 The Retreat and Your participation in the Retreat Activities by their very nature, carry a risk of (amongst other things) some discomfort and possible physical injury and Your Booking is accepted on the basis that You understand this. In making the Booking, You confirm that:
(a) You have full knowledge of and accept the various medical and physical risks that are inherent in Your participation in the Retreat, and Retreat Activities;
(b) You are expressly, knowingly and voluntarily assuming the risk of any and all physical or emotional injury or illness associated with or caused by Your participation in the Retreat, and Retreat Activities;
(c) if You have, develop or discover any medical or physical limitation or condition that might affect Your ability to safely participate in the Retreat Activities, You will make such limitations and conditions immediately known to Us and if requested or otherwise suggested by Us, You shall cease participating in the whole or the relevant part of the Therapeutic Sessions and Retreat Activities; and
(d) You release, discharge and hold harmless for Yourself, Your heirs, executors, administrators and assigns, Us, Our directors, staff and contractors from and in respect of any injury or illness that You may suffer as a result of Your participation in the Retreat, subject only to clause 10.5.
10.2 We recommend that You seek medical advice as to Your participation in the Retreat Activities. If You are unable, or decide not, to participate in the Retreat Activities, We will not be liable to supply alternative itineraries, excursions, accommodations, services or staff for the period when You are not present with other participants at the Retreat.
10.3 We are responsible for loss or damage you suffer that is a predictable or obvious result of Our breach of the Terms or Our negligence based on the information known to Us at the time we entered into this contract. We are not, however, responsible for any loss or damage that We could not reasonably predict may arise.
10.4 Subject to clause 10.5 under no circumstances shall our liability to You under these Terms exceed the amount actually paid by You to Us for the Retreat.
10.5 We do not exclude or limit in any way Our liability for:
(a) death or personal injury caused by Our negligence or the negligence of Our employees, or agents;
(b) Our fraud or fraudulent misrepresentation;
(c) breach of the terms implied by sections 3, 4 and 5 of the Supply of Goods and Services Act 1982 (description, satisfactory quality, fitness for purpose and samples); and
(d) defective products under the Consumer Protection Act 1987.
10.6 In the event You wish to bring any claim against Us for injury or illness caused by Our negligence or the negligence of Our employees or agents:
(a) You must notify Us about Your injury or illness while you are at the Retreat. You should also write to Us at the address in clause 14 below about Your claim within 2 weeks of departing the Retreat to allow Us to investigate it properly. Please include a letter about Your injury or illness from Your doctor if You can.
(b) You must show that reasonable care and skill has not been used. We will not be liable to You if your injury, illness or death was caused by or attributable to:
(i) an event or circumstances which the person who caused it could not have predicted or avoided even if they had taken all necessary and due care, or such injury or death is unforeseeable or unavoidable or is due to unusual circumstances beyond our control;
(ii) Your own acts or omissions; or
(iii) a third party unconnected with the provision of the Retreat.
(c) If any international convention applies to or governs any part of the delivery of the Retreat and You make a claim against us arising out of death, injury or loss suffered during or as a result of the delivery of that part of the Retreat, Our liability to pay You any compensation and/or the amount of compensation payable to You by Us will be limited in accordance with and/or in an identical manner to that provided for by the international convention concerned (in each case including in respect of the conditions of liability, the time for bringing any claim and type and amount of any damages that can be awarded). This means that We are to be regarded as having all the benefit of any limitations of compensation in any conventions applicable to the delivery of the Retreat and any payment We make to You may be limited accordingly.
11. Travel & Health insurance
11.1 By placing a Booking You confirm that You have, or agree that You will promptly obtain appropriate travel, health, cancellation and holiday insurance to cover You (and each member of Your party) in respect of Your Booking including, but not limited to any costs, risks, losses, damages or expenses which may arise from Your attendance at the Retreat, Your participation in the Retreat Activities or any other ancillary activities We may provide or any cancellation of or changes to Your Booking. You must carry proof of insurance with you on the Retreat.
11.2 We strongly recommend that You bring a valid European Health Insurance Card (previously E111).
12. If there is a problem with the Retreat
12.1 In the unlikely event that You are unhappy with any aspect of the Retreat please contact Us and tell Us as soon as reasonably possible and give Us a reasonable opportunity to agree a course of action to resolve Your concerns.
12.2 In order to ensure that Your concern is resolved with minimum disruption and disappointment to Your enjoyment of the Retreat please give Us an opportunity to address Your concerns during Your stay.
12.3 If, however, You are still not satisfied on Your return home, please contact Us as detailed below in order for Your issue to be investigated properly.
12.4 As a consumer, you have legal rights in relation to any services which are not carried out with reasonable skill and care, or if the materials We use are faulty or not as described. Nothing in these Terms will affect those legal rights. For more information about Your legal rights please contact Your local Citizens' Advice Bureau or Trading Standards office.

13.2 Alternatively, if You wish to contact Us in writing, or if any clause in these Terms requires You to give Us notice in writing (for example, to cancel the contract), You can send this to Us by e-mail, by hand, or by pre-paid post to Nourish and Flourish Retreats Ltd, at 6 Feilden Court, Well Lane, Mollington, Chester CH1 6LS and/or info@nourishandflourishretreats.co.uk. We will always try to confirm receipt by contacting You in writing.
13.3 If We have to contact You or give You notice in writing, We will do so by e-mail, by hand, or by pre-paid post to the address You provide to Us in the Booking Form.
14. How we may use your personal information
14.1 We will need certain personal information from You (such as Your name, address, contact telephone number, email address, details of Your doctor and of any medical conditions or injury You have and any treatments You have received to date) in order to provide and allow You to participate in the Retreat.
14.2 We will use the personal information you provide to Us to:
(a) provide the Retreat;
(b) process Your payment for the Retreat; and
(c) inform You about similar retreats of services that We provide which we think may interest you, but You may stop receiving these at any time by contacting Us.
14.3 We will not give Your personal data to any third party save for those contractors and/or agents who provide any part of the Retreat Activities.
14.4 If You do not provide Us with the necessary information when asked, or you provide Us with incomplete or incorrect information, We may refuse to accept Your Booking or, if Confirmation has been sent, cancel Your Booking by giving You written notice in which case clause 9.3 shall apply.
15. Other important terms
15.1 We may revise these Terms by giving You 30 days' written notice from time to time but any such revisions will not apply to Bookings We have Confirmed. To avoid any confusion We recommend that You print and retain a copy of these Terms at the time You make Your Booking.
15.2 This contract is between you and Us. Nobody other than You and Us will have the right to enforce any of its terms.
15.3 Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the other parts will continue to apply.
15.4 These Terms are governed by English law and if You are not happy with how We deal with any disagreement and want to bring court proceedings against Us, You must do so within the UK.
16. Definitions
16.1 Where the following words with capital letters are used in these Terms, this is what they mean:
(a) Booking: a booking for a place on the Retreat;
(b) Booking Form: the registration form provided to You upon request from Our website www.nourishandflourishretreats.co.uk and completed by You in relation to your Booking;
(c) Confirmation: the email sent by Us acknowledging receipt of Your Booking, confirming details of Your reservation subject to payment of the deposit;
(d) Departure Date: Your scheduled date of departure for the Retreat as detailed in the Booking Form;
(e) Medical Questionnaire: the medical questionnaire which will be provided to You upon and alongside the Booking Form;
(f) Price: the price of the Retreat as detailed on the Confirmation or otherwise notified to You in accordance with clause 2.2;
(g) Retreat: the retreat package as more particularly detailed in the Booking Form;
(h) Retreat Activities: the activities offered by the Retreat, including Yoga & meditation classes, Nordic Walking classes and guided daily walks:
(i) Terms: the terms and conditions set out in this document;
(j) We/Our/Us: Nourish and Flourish Retreats Ltd, a company registered in England and Wales (company number 08062323) whose registered office is at 221 Shoreditch High Street, London, United Kingdom E1 6PP; and
(k) You/Your: the person who makes the Booking and/or who participates in the Retreat.
16.2 When We use the words "writing" or "written" in these Terms, this will include e-mail unless We say otherwise.
